The sheriff's office is the first stop for most Benton County police records requests. They handle arrest data, incident reports, and records from calls for service across the county. Some requests can be filled on the same day. Others may take a few days depending on how old the record is and whether it involves an open case. If you know a case number or incident number, include it with your request to speed things up. Staff will look up records by name or date range if you do not have a number handy.

The sheriff's website links to department services and may post recent news or press releases about law enforcement activity in Benton County. These posts can be a quick way to find information about recent arrests or public safety notices without submitting a formal request.

How to Request Police Records in Benton County

Under Minn. Stat. 13.03, any person can inspect public government data. You do not need to explain why you want a record or show any ID in most cases. The right to inspect is free. If you want printed copies, the fee is $0.25 per page for the first 100 pages. After 100 pages, the agency can charge the actual cost of producing the copies.

To request records from the Benton County Sheriff's Office, you can visit the office at 581 Highway 23 in Foley during business hours. You can also submit a written request by mail. Include the date range, type of record, and any case or incident number you have. Be specific about what you are looking for. Vague requests take longer to process. If the agency denies your request, they must cite a specific statute that lets them hold back the data. A general claim that records are "private" without a legal citation is not a valid denial.

Note: Records tied to open or active investigations are not available while the case is pending. Once a case closes, most data becomes public unless a specific law classifies it otherwise.

Mail requests should be sent to the Benton County Sheriff's Office records division. Include your name and a return address so they can send copies or reach you with questions. Processing times vary by workload and how far back the record dates. Older archived records may take a bit longer to pull. If you need records quickly, stopping in person is often the most direct option.

Some requests can be handled by email or through the county website's contact form. Check the sheriff's page at www.co.benton.mn.us/226/Sheriff for the most current options. The office may update its process from time to time, so it is worth checking before you come in.

The sheriff's office site at www.co.benton.mn.us/226/Sheriff is your starting point for records requests and department information in Benton County.

Minn. Stat. 13.82 defines what law enforcement data is public. From the moment of arrest, the following data becomes public: the arrested person's name, age, sex, and address; the charge or alleged offense; the date, time, and place of arrest; and the identity of the arresting agency. This is the core of what most people mean when they ask about arrest records. You do not need a court order or special permission to get this data.

Beyond arrest data, public police records in Benton County can include incident reports from calls for service, reports of crimes, traffic stops, and other law enforcement contacts. Booking photos are also public under state law. What is not public: 911 audio recordings are private, though transcripts of those calls are generally available to the public. Data about active criminal investigations is classified until the case is resolved or prosecution ends.

Victim data is handled separately. Names and personal details of crime victims may be protected in certain cases, especially for domestic violence, sexual assault, or crimes involving minors. The agency will tell you when victim data has been removed from a record before it is released to you.

Online Access: Minnesota Court Records

For court case information, the Minnesota Courts Records Online (MCRO) system is a free public tool. You can search by name or case number at publicaccess.courts.state.mn.us. MCRO shows filed cases, charges, hearing dates, and case outcomes for cases handled in the 7th Judicial District, which includes Benton County. This is useful when you want to see if an arrest led to charges and how those charges were resolved.

MCRO does not show every police contact. It only shows cases that were filed in court. If someone was arrested and not charged, or if charges were dropped before filing, that event may not appear in MCRO. For the full picture, check both the sheriff's office records and the court system. The two sources together give you the most complete view of someone's law enforcement history in Benton County.

The 7th Judicial District courthouse for Benton County is located in Foley. Case filings, hearing schedules, and court documents can also be reviewed in person at the courthouse during business hours. Clerk staff can assist with searches if you need help using the public terminals.

Criminal History and BCA Background Checks

The Minnesota Bureau of Criminal Apprehension (BCA) maintains statewide criminal history records. If you need a formal background check, the BCA is the right agency to contact. Reach the BCA at 651-793-2400, option 7. Their public background check portal is at dps.mn.gov/divisions/bca/Pages/background-checks.aspx.

Under Minn. Stat. 13.87, criminal history data held by the BCA is generally private except for data on individuals who are currently in the criminal justice system. The public criminal history tool gives limited information. Full background checks with complete history require a separate process and may have fees attached. The BCA website explains current options and costs clearly.

For most informal searches, MCRO is a better starting point. It is free and covers court cases statewide. The BCA process is better suited for comprehensive checks when you need a full, certified record.

Your Data Access Rights in Benton County

Minnesota's Government Data Practices Act, found at Minn. Stat. 13.025, sets the framework for all public records in the state. The default rule is that all government data is public unless a specific law says otherwise. This puts the burden on the government to justify withholding data, not on the public to justify requesting it. Benton County agencies must follow this rule just like any other government entity in the state.

If you want to see data about yourself that a county agency holds, Minn. Stat. 13.04 gives you specific rights. You can ask to see your own data, correct errors in it, and challenge information you believe is wrong. You have 30 days to contest data after you find out about it, and 60 days to appeal a decision. These rights apply to any data about you held by the Benton County Sheriff, courts, or any other county department.

Note: If a government agency denies your records request without citing a specific law, you can file a complaint with the Minnesota Department of Administration's Information Policy Analysis Division.

Agencies must respond to data requests in a timely way. For simple requests, a response the same day or within a few business days is expected. Complex requests involving large volumes of records or legal review may take longer, but agencies cannot ignore requests or delay without cause.
